That one-tenth is worked out against the mother’s price, just as the ghurra for the fetus of a free woman is reckoned from her diya, whether the child’s father is free or enslaved; the sum is paid to the woman’s owner.

If the fetus of a free woman is born alive, utters a cry, and then dies, its diya is one thousand dinars—that is, twelve thousand dirhams—and this amount is inherited from the child according to the shares laid down by Allah. The same applies to the fifty dinars that constitute the ghurra: they too are distributed as inheritance.

Whoever kills a pregnant woman incurs no liability for her fetus so long as it had not separated from her during her lifetime, nor is anything due for it if it is expelled dead after her death.
