The expiation (kaffārah) for accidental homicide is obligatory. No expiation is due for intentional killing, nor for the killing of a non-Muslim or a slave—although Mālik considered it recommended when a slave is killed by mistake.
The prescribed expiation is to free a believing slave; if none is available, the offender must fast two consecutive months. Should he be unable to fast, he waits until he becomes able; feeding the poor is not an option here, and if he does feed, it does not fulfill the requirement.
When several people jointly cause an accidental death, a single diya is taken from their respective ʿāqilahs, while each and every one of them must perform a complete expiation.
