so that it is shared between him and them, the male receiving the share of two females.

If the deceased is survived by three sisters of different categories, the full sister (sharing both parents) receives one-half, the paternal half-sister one-sixth to complete the two-thirds, and the maternal half-sister likewise one-sixth; whatever remains passes to the agnatic heirs.

Should there be six sisters of different categories, the two full sisters take two-thirds, the two maternal half-sisters one-third, and the two paternal half-sisters receive nothing.

A maternal half-brother or maternal half-sister does not inherit in the presence of the father, the paternal grandfather however remote, the son, the grandson through a son no matter how far removed, the daughters of the deceased, or the granddaughters through sons, however distant. Only when none of these heirs exist does a maternal half-brother qualify for one-sixth, and the same one-sixth is due to a maternal half-sister; male and female are equal in this respect. When the maternal half-siblings are two or more, they share one-third equally, without preference for the male.

Brothers and sisters through the father alone stand in the place of full brothers and sisters whenever no full sibling is present—except in the so-called Joint Case (al-mushtarakah), which consists of a husband, a mother, maternal half-siblings, and full siblings. In that scenario the full siblings share with the maternal half-siblings in their one-third portion, males and females alike being equal, because they are united by the same mother. Thus the maternal half-siblings take one-third, the mother one-sixth, and the husband one-half. The paternal half-siblings, however, receive nothing; for if the heirs were a husband, a mother, maternal half-siblings, and paternal half-siblings, the husband would take one-half, the mother one-sixth, the maternal half-siblings one-third, and the paternal half-siblings would be excluded entirely, being agnatic heirs with no residue left for them.

When brothers and sisters inherit alongside daughters, they receive whatever is left after the daughters have taken their prescribed shares; if nothing remains they are excluded, and for this reason they are called the daughters’ agnates.
