Majmu' al-FatawaIbn Taimiya

Chapter: Partition

He—may Allah Most High have mercy on him—was asked:

“Two men jointly own a house. One requests its partition, but his co-owner refuses. May he be compelled to agree to partition?”

He replied:

“Praise be to Allah, Lord of all worlds. If the house can be partitioned without detriment, such that its sale value is not diminished, the refusing party is compelled to accept partition. Otherwise, the party seeking partition is entitled to request its sale; the refusing party may be compelled to sell, and the proceeds are divided between them.

“Compulsory partition as described is the position of the four imams. Compulsory sale as described is the position of Mālik, Abū Hanīfah, and Imam Ahmad.”
