He was asked—may Allah sanctify his soul and illuminate his grave:
Concerning three thieves: two of them took some camels, and the third killed the camels. Are all three to be put to death?
He answered:
If the three were bandits who had joined together to seize property by armed force, all three are to be put to death, even if only one of them actually carried out the killing. And Allah knows best.
End of Volume Thirty-Four.
وَسُئِلَ - قَدَّسَ اللَّهُ رُوحَهُ وَنَوَّرَ ضَرِيحَهُ -:
عَنْ ثَلَاثَةٍ مِنْ اللُّصُوصِ أَخَذَ اثْنَانِ مِنْهُمْ جِمَالًا وَالثَّالِثُ قَتَلَ الْجِمَالَ:
هَلْ تُقْتَلُ الثَّلَاثَةُ؟
فَأَجَابَ:
إذَا كَانَ الثَّلَاثَةُ حَرَامِيَّةً اجْتَمَعُوا لِيَأْخُذُوا الْمَالَ بِالْمُحَارَبَةِ قُتِلَ الثَّلَاثَةُ وَإِنْ كَانَ الَّذِي بَاشَرَ الْقَتْلَ وَاحِدًا مِنْهُمْ. وَاَللَّهُ أَعْلَمُ.
