He—may Allah have mercy on him—was asked:
“Concerning the Prophet’s saying—may Allah bless him and grant him peace—‘Whoever drinks wine, flog him. If he does it again, flog him. If he does it again, kill him’: does this hadith have a basis, and who narrated it?”
He replied:
“Yes, it has a basis. It is narrated through several chains and is regarded as established by hadith scholars. However, most scholars say that it has been abrogated, and they hold several different views about what abrogated it. Some say, rather, that its ruling remains in force. Another view is that the obligation has been abrogated, while the permissibility remains. Ahmad, al-Tirmidhī and others narrated it, and I know of no one who has impugned it. Allah knows best.”
He—may Allah have mercy on him—was asked:
“A man breaks up sorghum and boils it in his pot, then takes it off the heat, adds wheat to it, leaves it until the next morning and strains it. On that day it is not intoxicating, but if he then leaves it for another two or three days, it becomes intoxicating. Is it permissible for him to drink some of it on the first day?”
