He replied:
If the person accused is chaste, the accuser must receive the prescribed punishment for accusing someone of unlawful sexual intercourse, if the accused requests it. As for other insults, if they are false, the offender must receive a discretionary punishment. If he wrongfully beats or imprisons him, he is to be treated as he treated the other man, and must compensate him for any benefit of which he deprived him.
He was asked—may Allah Most High have mercy on him:
About a man who accused another man, saying, “You are a sodomite, an illegitimate child”: what punishment must he receive?
He replied:
If he accuses him of unlawful sexual intercourse or sodomy—for example, by saying, “You are a sodomite”—and the man accused is a free Muslim who is not known for such conduct, the accuser must receive the prescribed punishment for such an accusation if the accused requests it. This is eighty lashes if the accuser is free, and forty if he is enslaved, according to the four imams.
