He replied:

Both the active and passive partners must be put to death by stoning, whether or not they have consummated a lawful marriage. This is because the Prophet, peace and blessings be upon him, said, as reported in the Sunan collections:

“Whoever you find committing the act of the people of Lot, kill both the active and passive partners.”

The Companions of the Prophet, peace and blessings be upon him, also agreed that both should be put to death. Both must perform a ritual bath to remove major ritual impurity, which is removed by bathing. However, they are not cleansed of the defilement of sin except through repentance. This is the meaning of the report:

“If they were to bathe with water, intending to remove major ritual impurity and make prayer permissible for themselves…”

He—may Allah have mercy on him—was asked:

Regarding the statement in al-Tahdhīb, “Whoever has intercourse with an animal, kill the animal subjected to the act and kill the person who commits it”: Is this obligatory or not?

He replied:

Praise be to Allah. There is a hadith concerning this, narrated by Abū Dāwūd in his Sunan, in which the Prophet said:

“Whoever has intercourse with an animal, kill him and kill the animal.”

This is one of the two scholarly opinions, including one of the two positions in the schools of Ahmad and al-Shāfi'ī.
