He replied:

Praise be to Allah. Her children and her male agnatic relatives must prevent her from committing forbidden acts. If she will desist only through confinement, they should confine her; if restraints are necessary, they should restrain her. A child should not strike his mother. They must not, however, withhold the dutiful kindness they owe her. Nor may they sever ties with her in a way that enables her to commit wrongdoing; rather, they must prevent her wrongdoing as far as they are able. If she needs food and clothing, they must provide them for her. They may not carry out the prescribed punishment against her, whether by killing her or otherwise; doing so would be sinful on their part.

He—may Allah Most High have mercy on him—was asked:

What about a town where slave women are left unrestrained and engage in unlawful intercourse with Christians and Muslims?

He replied:

If a slave woman commits unlawful intercourse, her master must carry out the prescribed punishment against her, as related in the two Sahīh collections from the Prophet, may Allah bless him and grant him peace:

“If the slave woman of any one of you commits unlawful intercourse, let him flog her. If she does so again, let him flog her. If she does so again, let him flog her. Then, if she does so a fourth time, let him sell her, even for a rope.”

The word zafīr means a rope. If he does not do what the Messenger of Allah, may Allah bless him and grant him peace, commanded him to do, he is disobedient to Allah and His Messenger. His persistence in that disobedience impairs his uprightness.

If, however, he sends her out to engage in prostitution and support herself from its proceeds, or takes any of those proceeds himself, then he is among those whom Allah and His Messenger have cursed. He is a vile evildoer: he has permitted a major sin, taken the earnings of a prostitute, and failed to forbid her indecency. Such a person may not serve as an assessor of others’ uprightness. Rather, he must not be allowed to remain among the Muslims; indeed, he deserves punishment

فَأَجَابَ: الْحَمْدُ لِلَّهِ، الْوَاجِبُ عَلَى أَوْلَادِهَا وَعُصْبَتِهَا أَنْ يَمْنَعُوهَا مِنْ الْمُحَرَّمَاتِ فَإِنْ لَمْ تَمْتَنِعْ إلَّا بِالْحَبْسِ حَبَسُوهَا؛ وَإِنْ احْتَاجَتْ إلَى الْقَيْدِ قَيَّدُوهَا. وَمَا يَنْبَغِي لِلْوَلَدِ أَنْ يَضْرِبَ أُمَّهُ. وَأَمَّا بِرُّهَا فَلَيْسَ لَهُمْ أَنْ يَمْنَعُوهَا بِرَّهَا وَلَا يَجُوزَ لَهُمْ مُقَاطَعَتُهَا بِحَيْثُ تَتَمَكَّنُ بِذَلِكَ مِنْ السُّوءِ؛ بَلْ يَمْنَعُوهَا بِحَسَبِ قُدْرَتِهِمْ. وَإِنْ احْتَاجَتْ إلَى رِزْقٍ وَكِسْوَةٍ رَزَقُوهَا وَكَسَوْهَا وَلَا يَجُوزُ لَهُمْ إقَامَةُ الْحَدِّ عَلَيْهَا بِقَتْلِ وَلَا غَيْرِهِ وَعَلَيْهِمْ الْإِثْمُ فِي ذَلِكَ. وَسُئِلَ - رَحِمَهُ اللَّهُ تَعَالَى -: عَنْ بَلَدٍ فِيهَا جَوَارٍ سَائِبَاتٍ يَزْنُونَ مَعَ النَّصَارَى وَالْمُسْلِمِينَ؟ فَأَجَابَ: عَلَى سَيِّدِ الْأَمَةِ إذَا زَنَتْ أَنْ يُقِيمَ عَلَيْهَا الْحَدَّ كَمَا فِي الصَّحِيحَيْنِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: {إذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا؛ ثُمَّ إنْ زَنَتْ فَلْيَجْلِدْهَا؛ ثُمَّ إنْ زَنَتْ فَلْيَجْلِدْهَا؛ ثُمَّ إنْ زَنَتْ فِي الرَّابِعَةِ فَلْيَبِعْهَا وَلَوْ بظفير} والظفير الْحَبْلُ. فَإِنْ لَمْ يَفْعَلْ مَا أَمَرَهُ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ عَاصِيًا لِلَّهِ وَرَسُولِهِ. وَكَانَ إصْرَارُهُ عَلَى الْمَعْصِيَةِ قَادِحًا فِي عَدَالَتِهِ. فَأَمَّا إذَا كَانَ هُوَ يُرْسِلُهَا لِتَبْغِيَ وَتُنْفِقَ عَلَى نَفْسِهَا مِنْ مَهْرِ الْبِغَاءِ أَوْ يَأْخُذَ هُوَ شَيْئًا مِنْ ذَلِكَ: فَهَذَا مِمَّنْ لَعَنَهُ اللَّهُ وَرَسُولُهُ؛ وَهُوَ فَاسِقٌ خَبِيثٌ؛ أَذِنَ فِي الْكَبِيرَةِ وَأَخَذَ مَهْرَ الْبَغِيِّ؛ وَلَمْ يَنْهَهَا عَنْ الْفَاحِشَةِ. وَمِثْلُ هَذَا لَا يَجُوزُ أَنْ يَكُونَ مَعْدِلًا؛ بَلْ لَا يَجُوزُ إقْرَارُهُ بَيْنَ الْمُسْلِمِينَ؛ بَلْ يَسْتَحِقُّ الْعُقُوبَةَ
