He—may Allah Most High have mercy on him—was asked:
Christians accused a man of killing some Christians, but nothing was proved against him. They brought him before the deputy governor in al-Karak and compelled him to punish the man. He was punished until he died, without confessing to anything. What liability, then, do the Christians who undertook responsibility for his death bear?
He replied:
They must pay compensation for the man for whose death they undertook responsibility, if he died under punishment. Indeed, they too are to be punished as he was, as Abū Dāwūd relates in al-Sunan from al-Nuʿmān ibn Bashīr, who issued a similar ruling. And Allah knows best.
