He—may Allah have mercy on him—was asked about someone who struck another person, causing him to lose the use of a finger.
He replied:
If his finger loses its function because of the wrongful injury inflicted upon him, the prescribed compensation for that finger is due, namely one tenth of the full blood money. And Allah knows best.
He—may Allah sanctify his soul—was asked about two men, one free and the other a slave, who were carrying a piece of timber. It accidentally fell from them and struck a man, who survived for two days and then died. What is due from the free man and the slave? And what is due from the slave’s owner if the slave is absent?
He replied:
If there was negligence or wrongful conduct on their part, both are liable for compensation. If, however, the victim himself was negligent by standing where he ought not to have stood, there is no liability. If there was no negligence on their part, neither is liable. If the harm occurred through indirect causation, there is no liability.
