He was asked—may Allah Most High have mercy on him—about a man who had been unable to have marital relations with his wife for seven years because of her illness: was she entitled to maintenance from him? If she was not entitled to it, but a judge ordered him to pay it, was he obliged to give it to her?
He replied:
“Yes, she is entitled to maintenance according to the schools of all four imams.”
He was asked—may Allah have mercy on him—about a man who divorced his wife once while she was pregnant, after which she miscarried: did his obligation to provide maintenance cease?
He replied:
“Yes. If she miscarries a fetus, her waiting period ends and her entitlement to maintenance ceases, whether or not the soul had been breathed into it, provided that its human form had become discernible. If its human form had not become discernible, there is disagreement on the matter.”
