He was asked—may Allah Most High have mercy on him—about a woman who died, leaving among her heirs a son who claimed from his father the dower and clothing due to her: “Is the husband liable for the clothing owed for the period before her death, given that the son is in need?”
He replied:
“If the circumstances are as stated, the father must pay him what he is entitled to. Indeed, even if the son had no inheritance, but was in need and unable to clothe himself, the father, if well-to-do, would be obliged to provide maintenance for him, his wife, and his young children who are in need and unable to earn a living.”
He was asked—may Allah have mercy on him—about a man who married a woman and consummated the marriage, and continued to provide her maintenance despite her defiance of her marital obligations. Her father then took her away and travelled with her without the husband’s permission. What consequences do the father and daughter face?
He replied:
“Praise be to Allah. If he travelled with her without the husband’s permission, he is subject to discretionary punishment for doing so. The wife is likewise subject to discretionary punishment if she could have remained behind. She is not entitled to maintenance from the time she departed. Allah knows best.”
