Majmu' al-FatawaIbn Taimiya

The scholars differed over whether human milk may be sold on its own, holding three views within the school of Ahmad and elsewhere. One view permits its sale, as does the school of al-Shāfi‘ī. Another prohibits it, as does the school of Abū Hanīfah. A third permits the sale of an enslaved woman’s milk, but not that of a free woman. Allah knows best.

He—may Allah have mercy on him—was asked:

Two women had children, one a son and the other a daughter. The daughter’s mother breastfed the son several times, then the son died. Another son was subsequently born who was not breastfed by that woman. May he marry the daughter mentioned, or is she forbidden to him because his brother was breastfed by her mother?

The answer:

If the biological brother of a breastfed child wishes to marry one of the nursing woman’s daughters, that is permissible by agreement of the imams, whether the breastfed child is alive or dead. Allah knows best.

He—may Allah have mercy on him—was asked:

A man has a female cousin, the daughter of his paternal uncle. Her father was breastfed by the man’s mother alongside one of the man’s brothers. The man’s mother stated that when he nursed from her, he was more than two years old. May the man marry his paternal uncle’s daughter?

He replied:

If the breastfeeding took place after two full years of age, it establishes no marriage prohibition.
