Chapter: Making Divorce Conditional
Shaykh al-Islām—may Allah have mercy on him—was asked:
A man swore an oath on pain of divorce, then added the qualification “if Allah wills” after a brief pause, long enough for words to be spoken. What is the ruling?
He replied:
In these circumstances, no divorce takes effect, and no expiation is required of him.
Even if someone prompted him, saying, “Say: ‘If Allah wills,’” this would still avail him, even if adding the qualification had not occurred to him until he was prompted. And Allah knows best.
He—may Allah have mercy on him—was asked:
A man became angry with his wife and said, “You are divorced three times.” His wife said to him, “Say ‘now.’” He said, “Now,” intending an exception. What is the ruling?
