He—may Allah Most High have mercy on him—was asked about a man who found his maternal aunt’s son with his wife and swore on pain of divorce that his maternal aunt’s son had been with his wife, as was indeed the case.
He replied:
If the man is truthful in what he swears, he has not broken his oath. Likewise, if he believes himself to be truthful, he has not broken his oath, even if the reality is otherwise, according to the sounder of the two scholarly views. And Allah knows best.
He—may Allah have mercy on him—was asked about a man who swore on pain of divorce that he would not marry a particular woman, but then changed his mind and wished to marry her. May he do so?
He replied—may Allah illuminate his resting place and his tomb:
All praise is due to Allah, Lord of all worlds. He may marry her, and no divorce takes effect with respect to her when he marries her, according to the majority of the early generations. This is also the position of al-Shāfiʿī, Ahmad, and others.
