He was asked:
About a man who swore by triple divorce that he would not live in the place where he was residing. He then moved out and vacated it. Is he permitted to return or not?
He replied:
If the reason for which he swore has ceased to exist, he may return. And Allah knows best.
Shaykh al-Islām—may Allah have mercy on him—was asked:
About a man who swore by triple divorce that his wife would not put her hand into his bag or take anything from it. He said this was for a period of four months. Afterwards, he swore a second oath that she would not pass on what she had heard to anyone.
She subsequently told people, so her husband said to her:
“Did I not swear by divorce that you would not pass it on to anyone? Yet you have passed it on!”
She said:
“I passed it on, but I did not know that I was bound by an oath.”
He said:
“Now the divorce has taken effect. Get up, give me my bag, and give me the thread from it. No oath remains binding on me, and the divorce has taken effect.”
