He replied:
All praise is due to Allah.
His instruction, “Hand her her document,” is an indirect expression for divorce. If the principal states that he intended divorce by it, or this is evident from the circumstances, the agent is authorized to pronounce one divorce, but not three, unless the principal authorizes him to do so.
If the principal tells the agent that he did not intend to authorize three divorces, his statement is accepted, and the agent is not permitted to pronounce three divorces. If the agent pronounces one divorce and the husband then takes her back, his taking her back is valid.
فَأَجَابَ:
الْحَمْدُ لِلَّهِ،
قَوْلُهُ:
يُسَلِّمُ إلَيْهَا كِتَابَهَا.
كِنَايَةً عَنْ الطَّلَاقِ فَإِذَا قَالَ الْمُوَكِّلُ:
إنَّهُ أَرَادَ بِهِ الطَّلَاقَ أَوْ عَلِمَ بِذَلِكَ بِدَلَالَةِ الْحَالِ: مَلَكَ أَنْ يُطَلِّقَ وَاحِدَةً وَلَمْ يَمْلِكْ الْوَكِيلُ أَنْ يُطَلِّقَ ثَلَاثًا إلَّا بِإِذْنِ الْمُوَكِّلِ. وَإِذَا قَالَ لِلْوَكِيلِ لَمْ أُرِدْ بِذَلِكَ أَنَّهُ يُطَلِّقُهَا ثَلَاثًا قَبْلَ قَوْلِهِ؛ وَلَمْ يُمْكِنْ الْوَكِيلُ أَنْ يُطَلِّقَهَا ثَلَاثًا وَإِذَا طَلَّقَهَا الْوَكِيلُ وَاحِدَةً ثُمَّ رَاجَعَهَا الزَّوْجُ صَحَّتْ الرَّجْعَةُ.
