He—may Allah Most High have mercy on him—was asked:
A man pronounced a threefold divorce against his wife before consummating the marriage, while she was still a virgin. Is there any way for him to take her back?
He answered:
Praise be to Allah. According to the four imams, a threefold divorce establishes the same prohibition whether pronounced before or after consummation.
He—may Allah have mercy on him—was asked:
A man contracted a marriage on the understanding that the woman had reached puberty. He neither consummated the marriage nor had intercourse with her, then pronounced a threefold divorce against her. Another man then contracted a marriage with her, but he too neither consummated the marriage nor had intercourse with her, then pronounced a threefold divorce against her. Is it permissible for the first man who divorced her to marry her again?
The answer
He answered:
According to the four imams, divorcing her before consummation is the same as divorcing her after consummation: she is not lawful for him until she marries another husband and that husband consummates the marriage with her. If the latter divorces her before consummation, she does not become lawful for the first husband.
