If it is objected:
It has been reported from 'Uthmān and Ibn 'Umar that khul' is a divorce. Hammād ibn Salamah narrated from Hishām ibn 'Urwah, from his father, from Jumhān, that Umm Bakrah al-Aslamiyyah was married to 'Abd Allāh ibn Asīd and obtained khul' from him. They both regretted it and brought their case before 'Uthmān ibn 'Affān, who approved it and said: “It counts as one divorce, unless you specified a particular number, in which case it is as you specified.”
Mālik also narrated from Nāfi', from Ibn 'Umar, who said:
“The waiting period for a woman who obtains khul' is the same as that of a divorced woman.”
Abū Dāwūd narrated:
“'Uthmān ibn Abī Shaybah narrated to us: 'Affān narrated to us: Hammām narrated to us, from Qatādah, from 'Ikrimah, from Ibn 'Abbās, that Barīrah’s husband was a black slave. The Messenger of Allah (may Allah bless him and grant him peace) gave her the choice and commanded her to observe a waiting period.” (1)
Ibn Abī 'Āsim likewise narrated it:
“Hudbah ibn Khālid narrated to us: Hammām narrated to us, from Qatādah, from 'Ikrimah, from Ibn 'Abbās, who said: ‘The Messenger of Allah (may Allah bless him and grant him peace) issued four rulings concerning Barīrah: he instructed her to choose and commanded her to observe a waiting period.’”
He also said:
“Al-Halwānī narrated to us: 'Amr ibn . . . (2) narrated to us: Hammām narrated to us, from Qatādah, from 'Ikrimah, from Ibn 'Abbās, mentioning the Prophet (may Allah bless him and grant him peace). He said: ‘I believe the wording included: “Observe the waiting period for khul'.”’”
Thus, this was an annulment for which he required a waiting period. For this reason, Ibn Hazm said that no annulment entails a waiting period except this one, because he does not accept analogical reasoning, and the text does not stipulate a waiting period for an annulment.
