Abū Dāwūd in his Sunan, al-Tirmidhī in his Jāmiʿ, and Abū Bakr ibn Abī ʿĀsim in his Book of Divorce. All three narrated it from Muhammad ibn ʿAbd al-Rahmān al-Baghdādī: ʿAlī ibn Yahyā al-Qattān narrated to us: Hishām ibn Yūsuf informed us, from Maʿmar, from ʿAmr ibn Muslim, from ʿIkrimah, from Ibn ʿAbbās, who reported:
“The wife of Thābit ibn Qays obtained a khulʿ from him, and the Prophet, peace and blessings be upon him, prescribed a waiting period of one menstrual period for her.”
Al-Tirmidhī said: “A good, singular hadith.” Al-Hākim also narrated it in his Sahīh.
Abū Dāwūd said: “ʿAbd al-Razzāq narrated this hadith from ʿAmr ibn Muslim, from ʿIkrimah, from the Prophet, peace and blessings be upon him.”
Al-Tirmidhī also narrated from al-Rubayyiʿ bint Muʿawwidh ibn ʿAfrāʾ:
“She obtained a khulʿ during the lifetime of the Messenger of Allah, peace and blessings be upon him. The Prophet, peace and blessings be upon him, instructed her—or she was instructed—to observe a waiting period of one menstrual period.”
Al-Tirmidhī said: “The correct version of al-Rubayyiʿ’s hadith is that she was instructed to observe a waiting period of one menstrual period.”
Al-Nasāʾī, Ibn Abī ʿĀsim, and Ibn Mājah narrated that al-Rubayyiʿ bint Muʿawwidh ibn ʿAfrāʾ said:
“I obtained a khulʿ from my husband. Then I went to ʿUthmān and asked what waiting period I was required to observe. He replied: ‘You are not required to observe a waiting period unless he has recently been intimate with you, in which case you must wait until you have had one menstrual period.’”
Ibn Mājah’s wording is: “You must remain with him until you have had one menstrual period.” Al-Nasāʾī and Ibn Abī ʿĀsim, however, did not include the words “with him.”
She said: “In this, he was simply following the ruling of the Messenger of Allah, peace and blessings be upon him, concerning al-Mughāliyah, who had been married to Thābit ibn Qays and obtained a khulʿ from him.”
These, then, are three chains of transmission for the hadith concerning the wife of Thābit ibn Qays ibn Shammās, with whom he concluded a khulʿ: “The Prophet, peace and blessings be upon him, instructed her to observe a waiting period of one menstrual period.” It was also narrated by Abū Bakr
