Shaykh al-Islām—may Allah have mercy on him—was asked:
Concerning a man whose wife has defiantly remained apart from him in her father’s house for eight months, during which he has had no marital relations with her?
He replied:
If she is defiant toward him, she is not entitled to maintenance. He may strike her if she is defiant, harms him, or acts aggressively toward him.
He—may Allah have mercy on him—was asked:
What is required of a husband if his wife refuses him intimacy when he requests it?
He replied:
Praise be to Allah. It is not lawful for her to be defiant toward him or to refuse him intimacy. Rather, if she refuses him and persists in doing so, he may strike her, but not severely, and she is not entitled to maintenance or an allotted share of his nights.
He was asked:
Concerning a man who married a woman and consummated the marriage, and who continues to provide her with maintenance although she is defiant. Her father then took her away and travelled with her without her husband’s permission. What is required of them both?
