Majmu' al-FatawaIbn Taimiya

He answered:

In these circumstances, she has no right to refuse to join her husband, by agreement of the imams. Neither her maternal aunt nor anyone else may prevent her from doing so. Rather, the aunt is to receive a discretionary punishment for preventing her from fulfilling what Allah has made obligatory upon her, and the woman is to be compelled to join her husband.

He—may Allah have mercy on him—was asked:

A man married a woman and then divorced her three times. She holds a written claim against him payable at a specified time, but he is insolvent. What is the ruling?

He answered:

If he is insolvent, she may not demand payment from him until he has the means to pay. If witnesses testify to his insolvency, their testimony is to be heard. Indeed, according to the schools of al-Shāfiʿī, Ahmad, and others, his word, supported by his oath, is accepted if he is not known to possess any wealth.

He—may Allah have mercy on him—was asked:

A man married a woman while outwardly appearing to be free. She lived with him for eleven years, after which he divorced her and did not take her back. When she demanded her financial rights from him, he said, “I am a slave and must be placed under legal interdiction.” Is he obliged to fulfil his wife’s rights under the rulings of the noble Sharia according to the four schools of law?
