Chapter: Defects Affecting Marriage
The Shaykh—may Allah have mercy on him—was asked:
A woman married a man, and after the marriage was consummated, she noticed vitiligo on his body. Does she have the right to annul the marriage?
He replied:
If either spouse is found to have insanity, leprosy or vitiligo, the other has the right to annul the marriage. However, anyone who accepts the defect after it becomes apparent no longer has the right to annul the marriage. If the wife annuls the marriage, she may not take anything from her trousseau. If she annuls it before consummation, her entitlement to the bridal dower lapses; if she annuls it after consummation, it does not lapse.
The Shaykh—may Allah have mercy on him—was asked:
A married man was found to have leprosy. Does his wife have the right to annul the marriage?
He replied:
All praise is due to Allah. If the husband is found to have leprosy, the wife has the right to annul the marriage without his consent. And Allah knows best.
