Shaykh al-Islām—may Allah have mercy on him—was asked:
About a man who has intercourse with his slave woman, knowing that another man also has intercourse with her, and does not safeguard her chastity.
He replied:
He is a dayyūth (a man who tolerates sexual immorality among his women), and “No dayyūth will enter Paradise.” Allah knows best.
He—may Allah Most High have mercy on him—was also asked:
About a man whose slave woman commits illicit intercourse: is it lawful for him to have intercourse with her?
He replied:
If she commits illicit intercourse, he may not have intercourse with her until she menstruates and he establishes that she is not pregnant from illicit intercourse. For:
“A man who commits illicit intercourse marries none but a woman who commits illicit intercourse or a polytheist.”
This applies both to the marriage contract and to intercourse. Whenever he has intercourse with her while she engages in illicit intercourse, he is a dayyūth. Allah knows best.
He—may Allah have mercy on him—was also asked:
About a hadith concerning the Prophet—may Allah bless him and grant him peace—in which “A man said to him: ‘O Messenger of Allah, my wife does not repel the hand of anyone who touches her.’” Does this mean that she does not withhold herself from anyone, or that she does not withhold her hand from giving to anyone? And is this hadith authentic or not?
