He—may Allah Most High have mercy on him—was asked:
About a man who went to his house and found an unrelated man with his wife. He paid her what was due to her and divorced her, then returned and reconciled with her. He subsequently heard that she had been found beside an unrelated man.
He replied:
It is reported in a hadith from the Prophet, may Allah bless him and grant him peace:
“When Allah, glorified and exalted be He, created Paradise, He said: ‘By My might and majesty, neither a miser, nor a liar, nor a dayyūth shall enter you.’”
A dayyūth is someone who has no protective jealousy.
An authentic hadith reports that the Prophet, may Allah bless him and grant him peace, said:
“The believer has protective jealousy, and Allah has jealousy. Allah’s jealousy is aroused when a servant does what He has forbidden him.”
Allah Most High has said:
“An adulterer marries none but an adulteress or a polytheist woman, and an adulteress is married by none but an adulterer or a polytheist man. That is forbidden to the believers.”
Therefore, the correct one of the two scholarly opinions is that a woman who commits illicit intercourse may not be married until she repents. Likewise, if a man’s wife is committing illicit intercourse, he may not keep her as his wife while she remains in that state. Rather, he must part with her; otherwise, he is a dayyūth.
