Shaykh al-Islām—may Allah have mercy on him—was asked:
A man entered into a marriage contract on the understanding that the bride was of age. He neither consummated the marriage nor had intercourse with her, then divorced her three times. Another man then married her, but likewise neither consummated the marriage nor had intercourse with her, then divorced her three times. May the first husband marry her again?
He replied:
If he divorces her before consummating the marriage, the ruling, according to the four imams, is the same as if he divorced her after consummation: she is not lawful for him until she marries another husband who consummates the marriage with her. If the second husband divorces her before consummation, she does not become lawful for the first.
He—may Allah have mercy on him—was asked:
A man married a virgin girl, then divorced her three times without having had intercourse with her. May he enter into a second marriage contract with her or not?
He replied:
According to most imams, divorcing a virgin three times has the same ruling as divorcing three times a woman with whom the marriage has been consummated.
