But if a Muslim owns a slave woman, he may give her in marriage by virtue of his ownership. Likewise, if he is charged with overseeing her marriage, he may give her in marriage by virtue of that authority. He may not, however, give her in marriage on the basis of kinship or having emancipated her. The only dissent on this point is an anomalous view reported from some of Mālik’s followers concerning a Christian giving his daughter in marriage, just as it has been reported from some of the early generations that he may inherit from her. Both views are anomalous.
The Muslims are agreed that a non-Muslim does not inherit from a Muslim and that a non-Muslim man may not marry a Muslim woman. Allah—glorified is He—has severed ties of allegiance between believers and disbelievers in His Book, required mutual disavowal, and established allegiance among believers. He, Most High, says:
“There has already been an excellent example for you in Abraham and those with him, when they said to their people: ‘We disavow you and whatever you worship besides Allah. We reject you, and enmity and hatred have appeared between us and you forever, until you believe in Allah alone.’”
He, Most High, also says:
“You will not find a people who believe in Allah and the Last Day showing affection to those who oppose Allah and His Messenger, even if they were their fathers, their sons, their brothers, or their clan. Those are the ones in whose hearts He has inscribed faith and whom He has strengthened with a spirit from Him.”
He, Most High, also says:
“O you who believe, do not take the Jews and Christians as allies. They are allies of one another. Whoever among you takes them as allies is indeed one of them. Surely Allah does not guide the wrongdoing people.”
Then, further on, He says:
“Your ally is none but Allah, His Messenger, and those who believe.”
And further on:
“Indeed, it is the party of Allah who will prevail.”
Allah Most High has established such ties between blood relatives only on condition of faith, as He, Most High, says:
“Blood relatives have a greater claim upon one another in the Book of Allah than other believers and emigrants.”
He, Most High, also says:
“Indeed, those who believed, emigrated, and strove with their wealth and their lives in the cause of Allah, and those who
