Majmu' al-FatawaIbn Taimiya

He—may Allah have mercy on him—was asked:

Two men were paternal half-brothers. The mother of one of them was a slave woman who had borne her master a child. She married a man and had two children by him. This woman’s son married and had a son, then died, leaving his son, who inherited from him. That son subsequently died. His paternal half-brother had already died during his lifetime, leaving a son. When the son died, his brother had left two—his father’s maternal half-brothers—and he also left a paternal cousin on his father’s side. What share belongs to his father’s brothers, and what share belongs to his paternal cousin?

He replied:

Praise be to Allah. The entire inheritance belongs to his paternal cousin on his father’s side. His father’s two maternal half-brothers receive no inheritance. This is agreed upon by the Muslims. However, a person should make a bequest to relatives who will not inherit from him. If he has made no bequest and they are present when the estate is divided, they should be given something from it, as Allah Most High says:

“And when relatives, orphans and the needy are present at the division, give them something from it and speak to them kindly.”

He was asked:

A man died, leaving two sons, two daughters, a wife and a brother’s son. The two sons subsequently died. The wife took her share and married an unrelated man, while the shares of the two sons remained undivided. The wife became pregnant by her new husband, and the remaining heirs wished
