He replied:
The husband receives one-quarter, and each parent receives one-sixth, together making one-third. The remainder is divided into three shares between the two children: two for the son and one for the daughter.
As for the father’s estate, his grandmother receives one-sixth and his father receives the remainder. His sister and grandfather receive nothing, as both are excluded by his father.
He—may Allah have mercy on him—was asked about a man who had children and acquired a slave woman, by whom he fathered a son. He then freed her, and she married and had children. The man died, having assigned a house specifically to his son by the slave woman; that son has also died. Are his maternal half-siblings entitled to any share alongside his paternal half-siblings?
He replied:
The mother receives one-sixth, his maternal half-siblings receive one-third, and the remainder goes to his paternal half-siblings, with each male receiving the share of two females. Allah knows best.
He—may Allah have mercy on him—was asked about a woman who died leaving a husband and a sister’s son.
He replied:
The husband receives half. As for the sister’s son, according to one view he receives the remainder. This is the position of Abū Hanīfa and his followers, of Ahmad according to the well-known view reported from him, and of a group of al-Shāfi‘ī’s followers.
