Majmu' al-FatawaIbn Taimiya

is more closely related than a son’s son. Thus, when there is only one daughter, she receives one-half, leaving one-sixth of the share allotted to daughters. If there are sons’ daughters, they would have been entitled to that entire share were it not for the daughter; once she takes one-half, the remainder is theirs.

The same applies to a full sister together with a paternal half-sister:

“Ibn Mas‘ūd reported that the Prophet, may Allah bless him and grant him peace, awarded the daughter one-half and the son’s daughter one-sixth, completing two-thirds.”

But when the daughters receive the full two-thirds, no prescribed share remains. If there is a male residuary heir among the descendants through sons, the remaining estate goes to him, because he is the nearest male relative. If she is of his generation or an earlier generation, he makes her a residuary heir, according to the majority of the Companions and scholars, including the four imams and others. Ibn Mas‘ūd, however, excludes her because she would not inherit on her own.

The disagreement also concerns a paternal half-sister together with her brother when the daughters have received the full two-thirds. The majority make daughters residuary heirs alongside their brothers, dividing the remainder so that each male receives the share of two females, whether inheriting as residuaries increases or decreases their shares. The case for their inheriting here is stronger, and Ibn Mas‘ūd’s position concerning a reduction in their shares is well known.
