and the sister half. Go to Ibn Masʿūd, for he will agree with us,’ he said: ‘Then I would indeed have gone astray and would not be among the rightly guided! I shall rule in this case according to the ruling of the Messenger of Allah, may Allah bless him and grant him peace: the daughter receives half; the son’s daughter receives one-sixth, completing two-thirds; and the remainder goes to the sister.’”

This establishes that sisters inherit as residuary heirs alongside daughters. A sister can become a residuary heir through another heir—her brother—so there is no impediment to her becoming a residuary heir alongside a daughter. As for the Prophet’s statement, may Allah bless him and grant him peace, “Give the prescribed shares to those entitled to them,” and so on, its wording is general, but exceptions have been made for a woman who frees a slave, a woman who undergoes mutual imprecation, and a woman who takes in a foundling. This is based on his statement, may Allah bless him and grant him peace:

“A woman receives three inheritances: from the person she freed, her foundling, and her child concerning whom she underwent mutual imprecation.”

Since this general statement already admits exceptions, the case under discussion is likewise excepted on the strength of the evidence already mentioned.

Section: The Inheritance of Two Daughters

Allah Most High says:

“Allah instructs you concerning your children: a male is entitled to the share of two females. If there are more than two daughters, they receive two-thirds of what he leaves; but if there is only one, she receives half.”

Thus, the Quran establishes that a daughter receives one-third alongside her brother, half when she is alone, and that more than two daughters receive two-thirds. There remains the daughter’s share in the remaining case: if she receives one-third, not one-quarter, alongside a male, then she is all the more entitled to one-third, not one-quarter, alongside a female.

For He also says: “And if there is
