and by the Prophet’s words (may Allah bless him and grant him peace):
“Give the prescribed shares to those entitled to them; whatever remains goes to the nearest male relative.”

As for sisters inheriting alongside daughters as residuary heirs—as He says, “and he has a sister”—this position, held by the majority of the Companions and scholars, is likewise supported by the Quran and Sunnah. Allah Most High says:
“They ask you for a ruling. Say, ‘Allah gives you a ruling concerning collateral inheritance: If a man dies leaving no child but a sister, she shall have half of what he leaves. He inherits from her if she leaves no child.’”
This indicates that the sister inherits half when there is no child, and that the brother inherits the entire estate when she leaves no child. It follows that, when there is a child, the sister does not receive half of what the deceased leaves. Otherwise, she would receive half whether or not he had a child, making the mention of a child misleading, pointless and harmful. Allah’s speech is exalted above such things. Among the passages illustrating this are His words:
“He leaves no child but has a sister; she shall have half of what he leaves,”
and His words:
“If he has no child and his parents inherit from him, his mother receives one-third.”
Once it is established that she does not inherit half when there is a child, that child must be either male or female.
