Book of Inheritance

Shaykh al-Islām—may Allah have mercy on him—was asked:

About a woman whose husband died, leaving children.

He replied:

The wife is entitled to her dowry. Regarding any portion still owed by him, she has the same standing as the other creditors. After the debts and any enforceable bequest, if there is one, have been discharged, she receives one-eighth of the remainder, alongside the children.

He—may Allah have mercy on him—was asked:

About a woman who died, leaving a husband and both parents. Her father had taken charge of the estate and stated that she lacked sound financial judgment. Is her husband entitled to inherit from her?

He replied:

Of what this woman left, her husband receives one-half, her father one-third, and her mother the remainder, which is one-sixth. This is the position of the four imams, whether or not she possessed sound financial judgment.
