Majmu' al-FatawaIbn Taimiya

the rest, he has no right to depart from the justice that Allah and His Messenger have commanded. How could he, when the Prophet, peace and blessings be upon him, said:

“Fear Allah and treat your children justly.”

He also said:

“I will not bear witness to injustice.”

Regarding a gift that favored one child over another, he said, “Take it back.” And, as a warning to the one who showed favoritism, he said:

“Have someone other than me witness this.”

And Allah knows best.

He was asked:

A man transferred ownership of some property to his daughter. She then died, leaving her father and her child. May the man revoke the transfer of what he had assigned to his daughter in writing or not?

He answered:

Praise be to Allah, Lord of all worlds. Whatever the daughter fully owned and had taken possession of passed to her heirs upon her death. Her father receives one-sixth, and the remainder goes to her son, provided she has no heir “other than the two of them.” By scholarly agreement, he has no right, after his daughter’s death, to revoke his transfer of ownership to her.

He was asked:

A man gave his daughter some jewelry to which no one else had any claim, and swore an oath, invoking divorce, that he would not take any of it from her. He then needed to take some of it from her. May he revoke his gift or not? If she willingly gives him some of it, does he break his oath or not?
