He replied:
Praise be to Allah. A donor may not take back his gift, except a father, unless the gift was intended to secure something in return, whether expressly stipulated or understood by custom. If it was given in return for something that was not received, the donor may take it back. And Allah knows best.
He was asked:
A gift was given to a man’s son, after which the man disposed of it and claimed that it belonged to him. Does this constitute taking back the gift?
He replied:
Yes, this constitutes taking it back. And Allah knows best.
He was asked:
A man gave someone a horse. Some time later, the donor demanded payment for its use. The recipient told him, “I cannot afford to pay anything. If that is not acceptable, take back your horse.” The donor said, “I will not take it back unless you pay me for its use.” Is this permissible, and is he entitled to payment for its use?
He replied:
If the recipient returns the gifted property itself, the donor is entitled to nothing beyond that. He may neither demand payment for its use nor claim compensation from the recipient, for the recipient bore liability for it and fed it in return for the benefit he derived from it.
