that they also be paid, from the village’s revenue, what their father reasonably spent from his own funds, as reimbursement for his expenditure. They are to recover this from the endowment’s income.

He—may Allah have mercy on him—was asked:

About the partition of an endowment and the division of its benefits.

He answered:

Where an endowment is dedicated to a single beneficiary or cause, its corpus may not be partitioned. Only its benefits may be divided through an agreed allocation of use. If the beneficiaries make such an arrangement and subsequently wish to revoke it, they may do so. If the arrangement was not made by the entitled beneficiary or his agent, it is invalid. And Allah knows best.

He was asked:

About an endowment dedicated to a single beneficiary or cause, which a Hanbalī partitioner divided, believing this permissible because the abridged legal manuals state: “If we hold that partition is a confirmation of existing shares, an endowment may be partitioned.” The two co-beneficiaries then exchanged some of the individual properties, after which one of them demanded his original share from the partition.
