Third: this shows that the order of succession mentioned above is one in which individuals succeed individuals. We have already explained this. May Allah, Glorified is He, guide us to what He loves and is pleased with. All praise belongs to Allah, Lord of the worlds. May Allah bless our master Muhammad, his family, and his Companions, and grant them abundant peace.

He—may Allah have mercy on him—was asked:

About an endowment for four persons: ‘Amr, Yāqūtah, Jahmah, and ‘Ā’ishah, its proceeds being distributed among them with each male receiving the share of two females. If any of them dies leaving a child, a grandchild, or descendants and posterity, however remote, whatever he had been receiving from it shall pass to his children, then to his grandchildren, then to his descendants and posterity, and thereafter to those succeeding him, however remote, with each male receiving the share of two females. If any of them dies leaving no child, grandchild, descendants, or posterity, his share shall pass as an endowment to his surviving siblings, then to their descendants and posterity, with each male receiving the share of two females, according to the condition and order of succession stated above. If these siblings, the beneficiaries of the endowment, have no descendants or posterity remaining, or if they all die without any one of them leaving descendants, the endowment shall pass to captives, then to the poor.

Then ‘Umar died, leaving Fātimah, and Fātimah died, leaving ‘Aynāshī, daughter of Ismā‘īl ibn Abī Ya‘lā. Then ‘Aynāshī died without descendants or posterity, and none remained of
