He—may Allah have mercy upon him—was asked:
About a man who transferred to another person ownership of property standing on land endowed for the benefit of the aforementioned person and others during his lifetime, and, after his death, for his children and any further children Allah might grant him, male and female, in equal shares, on the following conditions:
If any of them dies leaving a child, his share of the endowment shall pass to his child, or his grandchild or more remote descendants, whether one or more, male or female, descended through sons or daughters. Males and females shall receive equal shares. If he dies leaving no child, grandchild or more remote descendant, his share shall pass to those of the same degree of kinship, in addition to their entitlement to the income of this endowment. If he has neither a brother nor a sister, nor anyone of the same degree of kinship, his share shall pass to his nearest relatives, in order of proximity, through both male and female lines. The higher generation shall exclude the lower generation, with descendants through male and female lines treated equally, until they have all died out.
If no one remains whose lineage goes back to the beneficiary, whether through the father or through the daughter, the income of the endowment shall be allocated to the poor and needy in the protected frontier port of Damietta, those arriving there and those who frequent it. The administrator shall distribute it as he sees fit. Thereafter, it shall be allocated to Muslim captives.
