Majmu' al-FatawaIbn Taimiya

He—may Allah have mercy on him—was asked about the wording of an endowment deed, which reads:

“This is what Āmir ibn Yūsuf ibn Āmir has endowed for his children, Alī, Tarīfah, and Zubaydah, to be divided among them according to the shares prescribed by Islamic law; then for their children after them; then for their children’s children; then for their children’s children’s children; then for their descendants and posterity after them, however far down the line of descent, all according to the shares prescribed by Islamic law.

“This is subject to the condition that, if any of their aforementioned children, their children’s children, or their descendants and posterity after them dies leaving a child, a grandchild, descendants, or posterity, however far down the line of descent, the share endowed for that person shall pass to his child, grandchild, descendants, and posterity after him, however far down the line of descent, all according to the shares prescribed by Islamic law. If any of them dies leaving no child, grandchild, descendants, or posterity, however remote, the share endowed for that person shall pass to those beneficiaries of the endowment who belong to the same generation and degree of descent as him, according to the shares prescribed by Islamic law; then to purposes he specified in the endowment deed.”

The learned scholars are requested to examine the aforementioned founder’s stipulation. He then died leaving two daughters, who received what passed to them from him. Then one of them died leaving a son and a granddaughter through a son.
