He was asked:
When does the administrator of an endowment become entitled to his remuneration: from the time he is appointed, from the time the sultan enables him to take up his duties, or from the time he actually begins performing them?
He replied:
Praise be to Allah. The remuneration stipulated for the administrator is due in return for the work required of him. Whoever performs his required duties is entitled to his remuneration. And Allah knows best.
He was asked:
A man leased endowed land for thirty years at the customary rent from its lawfully authorized administrator and had the lease authenticated before a judge. Over four years, he erected buildings and planted on the property. He then travelled while the property remained under his lease and was absent for eleven years. Upon returning, he found that someone else had taken possession of the land and claimed to have leased it through legally valid means. Is the original lessee entitled to remove this second occupant and demand from him the difference in rent?
