Majmu' al-FatawaIbn Taimiya

He was asked:

Regarding unlawfully seized property, such as camels and other livestock, which increases while in the possession of the person who seized it: if he then repents, how should he dispose of the property? Is it unlawful or not?

He replied:

The fairest view on this matter is that the increase should be shared between the owner and the person tending the property, just as if the owner had entrusted it to someone to tend in return for a share of its increase. Then, if it is impossible to return the original property and the owner’s share to its owner, he should devote them to purposes benefiting the Muslims.

He was asked:

Regarding someone who unlawfully seized a sheep and then reached a mutually acceptable agreement with its owner: is it permissible to eat it?

He replied:

Yes. If he and its owner reach a mutually acceptable agreement, it is permissible to eat it.
