He was asked:

About merchants who were seized by robbers, who then returned some of their property to them: may anyone who recognizes any of his property take it, or should it be shared equitably in proportion to the amounts stolen from each, and so forth?

He replied:

Praise be to Allah. Whoever finds his actual property has the greater right to it. As for those whose property is no longer to be found, they should divide whatever compensation the robbers pay them in proportion to the value of their property, not according to the number of people. And Allah knows best.

He was asked:

About soldiers who camped somewhere overnight. Some people came and stole some of their belongings. They pursued the thief, and one of them struck him with a sword. He was then carried to the commander of the troops and subsequently died.

The answer

He replied:

If this was the means of recovering what the thief had taken, the man who struck him bears no liability.

Ibn ‘Umar related that a thief entered his house, whereupon he rose
