He replied:

Praise be to Allah, Lord of the worlds. Rather, the purchaser is entitled to recover from the usurper the price he received from him, whether or not the purchaser knew that the property had been unlawfully seized. The usurper received the price without right, even though the purchaser paid it willingly.

If the two had willingly traded something unlawful to sell, such as wine or a pig, the item sold would have to be returned, the wine or pig destroyed, and the price refunded to the purchaser. How much more so when he has sold him someone else’s property? On what grounds could the price remain in the usurper’s possession? He has no right to it; it belongs to the purchaser. And Allah knows best.

He—may Allah be pleased with him—was asked:

About a man who planted date stones on someone else’s land.

He replied:

Praise be to Allah. If he plants a date palm that he owns on another person’s land—his son’s—his son’s heirs have no right to the palm. Rather, the respective rights belong to him and the landowners: the palm belongs to him, and he must pay the landowners rent for the land if they allow it to remain there. And Allah knows best.

فَأَجَابَ: الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ، بَلْ لِلْمُشْتَرِي أَنْ يَرْجِعَ عَلَى الْغَاصِبِ بِالثَّمَنِ الَّذِي قَبَضَهُ مِنْهُ سَوَاءٌ كَانَ عَالِمًا بِالْغَصْبِ أَوْ لَمْ يَكُنْ عَالِمًا؛ فَإِنَّ الثَّمَنَ قَبَضَهُ بِغَيْرِ حَقٍّ وَلَوْ كَانَ بِرِضَاهُ. فَإِنَّهُمَا لَوْ تَبَايَعَا مَا لَا يَحِلُّ بَيْعُهُ: مِنْ خَمْرٍ أَوْ خِنْزِيرٍ بِرِضَاهُمَا لَوَجَبَ أَنْ يَرُدَّ الْمَبِيع فَيُتْلِفَ الْخَمْرَ وَالْخِنْزِيرَ وَيَرُدَّ عَلَى الْمُشْتَرِي الثَّمَنَ فَكَيْفَ إذَا بَاعَهُ مَالَ الْغَيْرِ؟ وَبِأَيِّ وَجْهٍ بَقِيَ الثَّمَنُ فِي يَدِ الْغَاصِبِ فَلَا حَقَّ لَهُ فِيهِ وَإِنَّمَا هُوَ مِلْكُ الْمُشْتَرِي. وَاَللَّهُ أَعْلَمُ. وَسُئِلَ - رَضِيَ اللَّهُ عَنْهُ -: عَنْ رَجُلٍ غَرَسَ نَوًى فِي أَرْضِ الْغَيْرِ؟ : فَأَجَابَ: الْحَمْدُ لِلَّهِ، إذَا غَرَسَ نَخْلَةً تَمَلَّكَهَا فِي أَرْضِ الْغَيْرِ ابْنُهُ لَمْ يَكُنْ لِوَرَثَةِ ابْنِهِ فِيهَا حَقٌّ بَلْ الْحَقُّ فِيهَا لَهُ وَلِأَهْلِ الْأَرْضِ فَالنَّخْلَةُ لَهُ وَعَلَيْهِ أُجْرَةُ الْأَرْضِ لِأَهْلِهَا إذَا أَبْقَوْهَا فِي أَرْضِهِمْ. وَاَللَّهُ أَعْلَمُ.
