Majmu' al-FatawaIbn Taimiya

He replied:

If the circumstances are as described, and he believed that what he swore was true, divorce does not take effect, even if he later discovers that he was mistaken. And Allah knows best. All praise is due to Allah, Lord of the worlds.

He—may Allah have mercy on him—was also asked:

Two men were with an emir, who said to one of them, “Ask to borrow your companion’s sword.” He complied, and the emir took it, but it was lost while in his possession. Should the claim be made against the emir or against the messenger who borrowed it?

He replied:

If the messenger neither lied nor exceeded his authority, he bears no liability. Rather, the borrower is liable if he was negligent or transgressed, by agreement of the scholars. Otherwise, the scholars differ over his liability. And Allah knows best.
