Majmu' al-FatawaIbn Taimiya

He—may Allah have mercy on him—was also asked:

A man leased another man’s land grant, comprising a share of one and a half qīrāts in the district, under a lawful lease allowing the tenant to cultivate it however he wished within lawful bounds. The lease did not describe it as a place for overnight or midday rest. Some of what was in the district was stolen, and the tenant derived no benefit from it. Must the tenant pay rent for the portion he could not use, or not?

He replied:

For whatever portion of the land irrigation has not reached, a corresponding amount of rent is remitted, by agreement of the scholars—even if the lease specifies “a place for midday and overnight rest” or leaves this unspecified. If none of the land is irrigated, no rent at all is due, by agreement of the scholars—even if the lease specifies “a place for midday and overnight rest.” And Allah knows best.
