Majmu' al-FatawaIbn Taimiya

And the party who does not undertake rebuilding and irrigation is barred from benefiting from what his property yields. Anyone who persists in neglecting an obligation thereby compromises his uprightness.

He was asked:

Concerning the leasing of endowed property: May it be leased for several years? And may each year be leased separately? If the lessee cuts down trees on the endowed property, must he compensate for their value or not? If someone purchases the endowed property for less than its value, what must he do?

He replied:

If the endowment serves a public purpose, it may be leased as its best interests require. According to most scholars, no fixed limit is set on the number of years. The lessee must pay compensation for whatever he cuts down. The beneficiary of the endowment may not sell the endowed property; rather, he must return the purchase price to the buyer, and the property remains an endowment as before.
