the landlord had already settled on letting the premises to someone, no one else may offer a higher rent. How much more so when that person is already living there and continuing to occupy the premises! Whoever does this deserves discretionary punishment. Allah knows best.

He was asked:

A man rented a house next to a bad neighbour. The tenant went to the landlord and said, “I am not willing to have him as my neighbour. Either move him elsewhere or return my rent.”

The landlord replied, “I will move him today.” The tenant then swore an oath invoking triple divorce that if the neighbour did not move that day, he would not live in the house. The tenant did not move out of the house. He then requested the rent, but it was not given to him.

He replied:

If the matter is as described, something like this constitutes a defect in the property. If the tenant was unaware of it when the contract was concluded, he is entitled to terminate the lease, and no rent is due from him from the time of termination. Allah knows best.
