lease. Whatever he has taken in this way, he must compensate his partner for his share. The owner may demand compensation from those who directly took it, but may not demand it from the partner who instructed them; he may recover his due from whichever of them he chooses. Allah knows best.

He was asked:

About a group of witnesses who entered into a partnership, with some doing more work than others. Are they entitled to equal shares of the remuneration, or should their shares be proportionate to their work?

He replied:

An unqualified partnership agreement entails equality in work and remuneration. If one of them does additional work as a voluntary contribution, the others receive the same remuneration as he does. If he did not intend it as a voluntary contribution, he may claim from them either the equivalent of his additional work or extra remuneration proportionate to his work. If they agree to stipulate an additional payment for him, that is permissible. Allah knows best.

He—may Allah have mercy on him—was asked:

About a group of brokers working in partnership to sell goods. Does this impugn their religious integrity? May the ruler—may Allah strengthen him—prohibit them from doing so when no cheating or deception has been found on their part?
