Majmu' al-FatawaIbn Taimiya

He—may Allah have mercy on him—was asked:

Is the agents’ nawba (crop-guarding arrangement), paid for by the farmers, lawful?

He answered:

If he guards the crop for the landowner and the farmer, he is entitled to payment for doing so. If the amount he charges the farmer corresponds to what the farmer owes him, there is nothing wrong with that. And Allah knows best.

He was asked:

A man authorized another man to make a purchase, but did not authorize him to rescind the sale by mutual agreement. The agent nevertheless did so. Is this rescission valid?

He answered:

If someone appoints an agent to purchase something without authorizing him to rescind the sale by mutual agreement, the agent has no authority to do so. His rescission does not take effect without the principal’s permission, by scholarly consensus. And Allah knows best.
